In this space, the user can find all the information regarding the legal terms and conditions that define the relationship between users and me as the person responsible for this website. As a user, it is important that you understand these terms before continuing your navigation.

RespiraMente (Alessandra Policreti), as the person responsible for this website, undertakes to process the information of my users and clients with full guarantees and to comply with the national and European requirements governing the collection and use of my users’ personal data.

This website strictly complies with Organic Law 15/1999 of December 13 on the Protection of Personal Data (LOPD), Royal Decree 1720/2007 of December 21, known as the Implementing Regulation of the LOPD, as well as Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons (GDPR), and Law 34/2002 of July 11 on Information Society Services and Electronic Commerce (LSSICE or LSSI).

General Conditions of Use

These General Conditions regulate the use (including mere access) of the webpages that make up the RespiraMente website, including the content and services made available on them. Any person who accesses the website https://www.respiramente.com (“user”) accepts to be bound by the General Conditions in force at any given time on the portal https://www.respiramente.com.

User commitments and obligations

The user is informed, and accepts, that access to this website does not in any way constitute the beginning of a commercial relationship with RespiraMente. The user therefore undertakes to use the website, its services, and content without contravening current legislation, good faith, or public order.

The use of the website for illegal or harmful purposes, or in any way that could damage or impede the normal functioning of the website, is prohibited. Regarding the content of this website, the following is forbidden:

  • Its reproduction, distribution, or modification, in whole or in part, unless authorized by me as the legitimate owner;
  • Any violation of the provider’s rights or mine as the legitimate owner;
  • Its use for commercial or advertising purposes.

When using the website https://www.respiramente.com, the user agrees not to carry out any conduct that could damage the image, interests, and rights of RespiraMente or third parties, or that could damage, disable, or overload the portal https://www.respiramente.com, or that could in any way prevent the normal use of the website.

However, the user must be aware that security measures for computer systems on the Internet are not entirely reliable. Therefore, https://www.respiramente.com cannot guarantee the absence of malware or other elements that may cause alterations to the user’s computer systems (software and hardware) or to their electronic documents and files, even though I put all necessary means and appropriate security measures in place to prevent the presence of such harmful elements.

The personal data provided by the user to RespiraMente may be stored in automated or non-automated databases, exclusively owned by Alessandra Policreti, who implements all technical, organizational, and security measures that ensure the confidentiality, integrity, and quality of the information contained therein, in accordance with current data protection regulations.

Intellectual and Industrial Property Rights

Under the provisions of Articles 8 and 32.1, second paragraph, of the Intellectual Property Law, the reproduction, distribution, and public communication of all or part of the contents of this website, including the manner in which they are made available, for commercial purposes, on any medium and by any technical means, are expressly prohibited without authorization from RespiraMente. The user undertakes to respect the Intellectual and Industrial Property rights owned by RespiraMente.

The user acknowledges and accepts that the entirety of the website—including, without limitation, text, software, content (including structure, selection, arrangement, and presentation), podcasts, photographs, audiovisual material, and graphics—is protected by trademarks, copyright, and other legitimate rights, in accordance with international treaties to which Spain is a party and other property and legal regulations in Spain.

If a user or third party believes that their legitimate intellectual property rights have been infringed by the inclusion of certain content on the website, they must notify RespiraMente, providing:

  • Personal data of the rights holder, or indication of representation if the claim is submitted by a third party;
  • Identification of the protected content and its location on the website, proof of the intellectual property rights in question, and an explicit declaration in which the claimant accepts responsibility for the accuracy of the information provided in the notification.

Terms and Conditions for the retreats

Below are the general terms and conditions for our accommodation and retreats. Please make sure you read and understand them. If you have any questions, please feel free to contact us. GENERAL TERMS AND CONDITIONS
These terms and conditions are applicable for all bookings of Respiramente Retreats. By making a booking you are accepting these terms and conditions.

1. Booking

Your booking is only definite when we receive a 300EUR deposit from you or, if registering less than 6 weeks before the start of the retreat, the full registration fee, and by doing so you agree to these terms and conditions.
A written/emailed confirmation sent by Alessandra Policreti confirms your reservation. It is essential that you supply us with a valid email address. If you change this you should inform us immediately.
Once your booking has been made and we have received your deposit, all further correspondence is by email. We will also email you all of the information that you need to get to the retreat location. We also require a mobile phone number so that we can contact you during your travel to the location or during your stay.

2. Payment
We give you the option to transfer for the retreat cost in full or you can transfer €300,- non-refundable deposit with the remaining balance to be paid 45 days before the start date of your retreat.

The remaining balance can be paid by bank transfer, details will be provided in your retreat confirmation.

3. Your Travel
All travel arrangements are your responsibility and at your own cost. We shall not be held liable for any consequences arising from delays or cancellations in any of the companies you may have made arrangements with or for any irregularities in your documentation required for travel. Airport transfers to/from the retreat are at your own cost. Let us know if you would like us to provide you with a transfer service.

4. Sickness
Medical costs are your responsibility. We are in no way responsible for any infectious diseases you may contract. In the event of an emergency, lockdown, or situation where it is against the law to travel to the accommodation, we will refund your payment. If you need to cancel a retreat due to illness, we will transfer your deposit to another
future retreat.

5. Travel Insurance
We recommend purchasing travel insurance that covers the activity of the retreat and medical treatment, accidents and repatriation, travel cancellation, sickness, losses and all the usual risks. You should bring the policy with you in case of an emergency.

6. Your Health
(a) It is your responsibility to let the retreat organizer know if you have any illness or injuries and to be mindful at all times of your own body’s capability during the retreat. If you experience any injury or discomfort during any activity during the retreat, you must desist immediately.
(b) It is also your responsibility to consult a doctor to check that you are sufficiently fit and healthy to participate in the retreat and other physical activities that you may choose to do whilst on the retreat.
(c) Please advise us of any health conditions and dietary requirements before you book or if you have health conditions and dietary requirements that may be affected by the activities offered on our retreats.
(d) Retreat participation, workshop, excursions, trips and breathwork classes are all undertaken at your own risk. For your safety and for the safety of the other participants and members of the team we need to make sure that we are
well informed regarding any special conditions. You will need to inform the retreat leader before attending the retreat. In the case of any serious health conditions (allergy, mentally and physically), you need to confirm that you are sufficiently fit and healthy to take part in the classes and other activities. Respiramente will not be liable for any injuries incurred during your stay.

7. Cancellation by you
(a) All deposits are non-refundable. If you cancel your booking for personal reasons, we will retain your deposit.
(b) If you cancel less than 45 days before the retreat due to sickness, and have a doctor’s certificate to validate this, we can transfer your deposit to another retreat.
(c) Bookings are for the stated period of the retreat. There are no refunds for any unused portion of the retreat. If the reason for cancellation is covered under the terms of your Insurance Policy, you may be able to claim on your insurance.

8. Amendments by us
Occasionally, we may make changes to the retreat schedule due to unforeseen circumstances, such as weather conditions. We reserve the right to make these changes at any time. If a significant change becomes necessary, we will inform you as soon as reasonably possible.

9. Cancellation by us
We reserve the right, in any circumstances, to cancel a retreat. We require a minimum of at least 75% of the participants to have booked 45 days before the start date. If this minimum number is not reached by that date, we may cancel and refund your payment. If we cancel the retreat for reasons out of our control (travel bans, lockdown), we will refund you in full (deposit included).

10. Our liability to you
(a) We accept the responsibility for ensuring that the retreats are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard.
(b) We do not accept any liability for cancellations, delays, or changes caused by war, the threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster, technical problems with transport, staff cancellations, unforeseen changes in your personal circumstances or other events beyond our control.
(c) We are not liable for any injuries you may incur. All activities are undertaken at your own risk. We are not liable for any medical or psychiatric conditions which may develop during or after the retreat. We are not liable for loss of or damage to your personal property.

11. No Liability for possessions
It is your responsibility to ensure that your possessions are kept safe at all times. This includes hire cars or other hired equipment.

Items left at the venue will be returned only upon request and at the guests’ expense. We are not liable for lost items. We will only hold items for 30 days before they are discarded.

12. Weather Conditions
One of the most wondrous aspects of the beautiful island of Tenerife is its climate. The weather is glorious, that is why Tenerife has earned the reputation of being one of the best year-round holiday hotspots. But due to many reasons the worlds weather conditions can be unpredictable and can change quickly and significantly. We cannot
be made liable for unpleasant or unsuitable weather conditions and no refunds are made for such conditions.

13. Complaints
If you have a problem during your retreat, please inform us immediately and we will try our best to put things right. If you are not satisfied with the proposed resolution, then any further comments or suggestions should be put in writing within 14 days of your return, specifying the problems to: info@respiramente.com.

Please note that we cannot be responsible for the individual behaviour of any group member or other guest sharing your accommodation.
